Terms of service

These Terms of Service (“Terms”) govern your use of the website operated by Robotx Pty Ltd (ABN 54 695 895 875) (“Robotx”, “we”, “us”, “our”) at robotx.au (“Site”). They do not, on their own, form a sales contract for any equipment or services. Specific commercial terms applicable to a transaction are set out in a separate written proposal, quotation, sales agreement or service agreement signed by the parties (“Sales Agreement”).

1. Acceptance

By accessing or using the Site you agree to these Terms. If you do not agree, please do not use the Site.

2. About Robotx

Robotx advises on, supplies, deploys and supports commercial robotic equipment for customers in Australia and New Zealand. Equipment is sold on an outright purchase basis under a Sales Agreement.

3. Use of the Site

When using the Site you must not:

• Use the Site in any way that breaches any applicable law.
• Attempt to gain unauthorised access to the Site, its servers or related infrastructure.
• Interfere with the operation of the Site or its security features.
• Use the Site to transmit malicious code, spam or unsolicited material.
• Submit information that infringes the rights of any third party or that is misleading or unlawful.

4. Information on the Site

Information on the Site is general information about commercial robotics and our services. It is not professional, legal, safety or engineering advice for your specific circumstances. While we take reasonable care in preparing it, we do not warrant that it is complete, current or free from error. Capabilities vary by platform and site. Specific product, manufacturer, technical and pricing information for any particular transaction is provided in writing during scoping and quotation, and prevails over any general information on the Site.

5. Forms and submissions

Information you submit through the enquiry form on the Site is handled in accordance with our Privacy Policy. You confirm that any information you submit is accurate to the best of your knowledge and that you are entitled to provide it to us.

6. Intellectual property

All content on the Site, including text, graphics, logos, images and video, is owned by or licensed to Robotx and is protected by intellectual property laws. You may view and print pages from the Site for your own internal business or personal, non-commercial use, but you must not otherwise reproduce, modify, distribute or exploit the content without our prior written consent. The “Robotx” name and logo are trade marks of Robotx Pty Ltd.

Manufacturer names, product names and logos are trade marks of their respective owners and are used to identify the products we supply. Their use does not imply that a manufacturer endorses any statement on the Site beyond our stated relationship with it.

7. Third-party links

The Site may contain links to third-party websites that are not under our control. We provide these links for convenience only and are not responsible for the content or practices of any linked sites.

8. Disclaimers

To the maximum extent permitted by law, the Site is provided on an “as is” and “as available” basis. We do not warrant that the Site will be uninterrupted, error-free or free from viruses or other harmful components. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law (Schedule 2 to theCompetition and Consumer Act 2010 (Cth)) or, where applicable, the Consumer Guarantees Act 1993 (NZ), that cannot be lawfully excluded.

9. Limitation of liability

To the maximum extent permitted by law, and subject to the rights and remedies referred to in clause 8, Robotx is not liable for any indirect, incidental, special or consequential loss, or any loss of profits, revenue, data, use or goodwill, arising out of or in connection with your use of the Site, including reliance on general information on the Site. The liability of Robotx in respect of any equipment or services supplied to a customer is governed by the relevant Sales Agreement.

10. Indemnity

You indemnify Robotx against loss or damage suffered by Robotx to the extent caused by your misuse of the Site, your breach of these Terms, or your breach of applicable law in connection with your use of the Site.

11. Changes to these Terms

We may update these Terms from time to time. The current version is always available on this page. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

12. Governing law and jurisdiction

If you are located in Australia, these Terms are governed by the laws of New South Wales, Australia, and you submit to the exclusive jurisdiction of the courts of New South Wales and the courts entitled to hear appeals from them.

If you are located in New Zealand, these Terms are governed by the laws of New Zealand, and you submit to the exclusive jurisdiction of the courts of New Zealand sitting at Auckland and the courts entitled to hear appeals from them. Nothing in these Terms limits any rights you have under New Zealand law that cannot be lawfully excluded.
